Rental Terms and Conditions

  1. The Lessor provides the Lessee with a construction mechanism along with an operator for performing the works specified by the Lessee.

  2. The Lessee or a designated representative assigns tasks to the mechanism operator.

  3. The Lessee shall adhere to good practices in work execution and the guidelines for using the mechanism. If the Lessee violates these, the mechanism operator has the right to refuse task execution.

  4. An authorized person of the Lessee shall sign the mechanism’s time sheet. The Lessee shall pay invoices based on the signed time sheets within the agreed deadline.

  5. In the event of loss or destruction of the mechanism, the Lessee shall compensate the Lessor with an amount equivalent to the retail price of a new, similar mechanism. If the mechanism is damaged, including due to vandalism, or its value decreases beyond normal wear and tear under reasonable use, the Lessee shall pay for repairs and material costs at market price.

  6. The compensation principles specified in clause 5 apply regardless of the Lessee’s actions or inactions, including cases of theft, loss, or destruction of the mechanism, except when caused by the operator’s actions.

  7. The risk of accidental destruction of the mechanism transfers to the Lessee upon possession. The Lessee bears full and unconditional liability (strict liability) for the mechanism’s preservation from the moment of possession until its return to the Lessor.

  8. The Lessee’s full and unconditional liability remains even if the mechanism is lost, destroyed, or damaged due to reasons beyond the Lessee’s control. The Lessor and the Lessee confirm that the Lessee is not entitled to claim exemption from liability under § 334(2) of the Law of Obligations Act or any other legal basis.

  9. The Lessee shall arrange and bear the costs of accommodation for the mechanism operator if needed. If the Lessee cannot provide accommodation, an additional charge of €1 per hour worked will be added to the hourly rental rate.

  10. The minimum rental period per workday is 6 hours. If the Lessee uses the machine for a shorter period, they must still pay for 6 hours.

  11. Services provided on weekends, evening and night hours, or public holidays are subject to a 10% higher hourly rate unless agreed otherwise. Evening hours are from 18:00 to 22:00, and night hours are from 22:00 to 06:00.

  12. The Lessor supplies fuel for the mechanisms at their own expense unless otherwise agreed. If the mechanism is not transported to the Lessor for storage outside working hours, the Lessee shall arrange and cover the storage costs.

  13. The Lessee is responsible for safety at the construction site and must prevent unauthorized persons and equipment from entering the mechanism’s operating area.

  14. The Lessee is prohibited from allowing third parties to use the mechanism without the Lessor’s written consent.

  15. Any complaints regarding the quality of the ordered machine or operator’s work must be submitted in writing immediately, along with supporting evidence. To resolve complaints, the Lessor’s representative must be summoned to the site without delay.

  16. The operator shall perform work in the protective zones of existing electrical and communication cables, as well as water and sewage pipelines, only under the Lessee’s special instructions and full responsibility. Electrical and communication cables, as well as water and sewage pipelines, must be manually excavated, marked, and visible.
